There is a single question presented by the appeal now before the Court: do the non-forfeitability provisions of the Employees Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. § 1053(a), prohibit the reduction of pension benefits by the amount that a pensioner receives in workers’ compensation insurance benefits? Although this question appears simple, it in fact raises several difficult issues of statutory interpretation.
