The appellee brought this action against the appellant for the recovery of damages on account of the closing by appellant of the crossing over its railway track of a road leading from the appellee’s premises over the railway into a public road running from the town of Biehmond towards the city of Houston. The damages claimed were for injury to the business of appellee as a truck farmer in preventing him from getting Ms produce to market, and in the prevention of access to his farm by his customers.
