This matter is before this Court on Respondent Colie L. Rushton’s (“Respondent”) Motion for Summary Judgment on Petitioner Willie Lee Tucker’s (“Petitioner”) petition for habeas corpus relief pursuant to 28 U.S.C. § 2254.
