Order, Supreme Court, New York County (Lorraine Miller, J.), entered January 6, 1999, which awarded the temporary receiver the maximum commission, charged the commission to appellant and awarded interest based on New York law, modified, on the law, the facts and in the exercise of discretion and the matter is remanded for an evidentiary hearing to determine the proper commission for the temporary receiver and the appropriate allocation of such commission, and otherwise affirmed, without costs.
