HARPER, Judge.

Appellant was prosecuted, convicted and sentenced to two years in the penitentiary under the following indictment, omitting the formal parts:

“That in said County of Bastrop, and State of Texas, on or about the 3rd day of February, A. D. 1912, and before the presentment of this indictment, E. F. Brown did then and there unlawfully assent to the reception of a deposit of money in the sum of $50, current money of the United States, of the value of $50, from and by A. DeGlandon, Sr., which said amount of money was' placed to the open deposit account of and subject to the check of A.…
