Defendant Glen Perkins McCune was convicted of second- degree murder as a result of the shooting to death one Chester Palek at the home of defendant’s former wife. The defendant urges reversal on several grounds, none of which we find to be meritorious. We therefore affirm.

Defendant’s first contention is that the trial judge erred in refusing to instruct the jury on the elements of common-law marriage.
