The merits of the controversy were involved in the question whether the lumber attached was, at the time, the property of the plaintiffs, or in fact the property of Benjamin Brickley. The verdict rendered necessarily found it to be the property of the plaintiffs. Such verdict is challenged as not being supported by. the evidence. It must be confessed that there are suspicious circumstances connected with the alleged acquisition of title by the plaint*567iffs.
