This is a motion by the petitioner in the proceeding for the revocation of letters testamentary, for summary judgment revoking the letters issued to Paul M. Kaufman, one of three executors, upon the ground that he was ineligible to act as fiduciary, being ‘ ‘ a felon ’ ’ (.SCPA 707, suibd. 1, par. [d]), and his letters must be revoked under subdivision 1 of SCPA 711.
