Morrisey v. Regan

— Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which denied petitioner’s application for accidental disability retirement benefits.

Contrary to petitioner’s contention, there is substantial evidence in the record to support respondent’s determination that she is not permanently disabled from performing her duties as a professor (see, Matter of DiFede v Regan, 130 AD2d 832). The medical evidence showed conflicting diagnoses as to the cause and extent of petitioner’s disability.…
