The appellee, Narcissa I. Mitchell, filed her bill in this case in the circuit court of Franklin county against her husband, Arthur C. Mitchell, for separate maintenance and to set aside a post-nuptial contract and deed. The court granted the relief prayed for and the record was brought to this court by appeal. The decree was reversed because the complainant had not restored or offered to restore, so far as she was able, the consideration received in the transaction which she asked to have set aside, and the cause was remanded to the circuit court.
