During the trial of this case, the defendant offered to incorporate the record in Florea & Co., Inc. v. United States (Re-appraisement 123770-A), 9 Cust. Ct. 645, Reap. Dec. 5733, because of the similarity of issues and merchandise in both cases. Plaintiff objected and insisted so strenuously that the motion of defendant to incorporate the decided case violated the rule invoked in such matters that only after lengthy argument by counsel was it admitted.
