The plaintiffs, both of whom are petitioners in bankruptcy, have moved for summary judgment pursuant to Rule 56, Fed.R.Civ.P., and have invoked the Court’s jurisdiction under the Mandamus and Venue Act, 28 U.S.C. § 1361. They seek an order requiring the defendant-Referee in Bankruptcy to certify and transmit to this Court plaintiffs’ petitions for review of the orders made by him without payment of the $10.00 filing fee.
