This case is before the court on petition for review of a decision of the court of appeals, Saenz v. Murphy, 153 Wis. 2d 660, 451 N.W.2d 780 (Ct. App. 1989). The court of appeals affirmed in part and reversed in part a judgment of the circuit court for Dane county, George A.W. Northrup, Circuit Judge. The circuit court granted summary judgment to the defendants on the grounds that Jerry Saenz (Saenz) was accorded due process of law and, therefore, did not have a cause of action under 42 U.S.C. sec. 1983 (1988) [hereinafter sec. 1983].1 The court of appeals held that Saenz did have a cause of…
