This is an action for damages brought by John N. Maul for personal injuries and property damage sustained by him (respondent) as a result of a collision on August 19, 1955, between a Dodge automobile he was driving northwardly on U. S. Highway No. 67 about one-half mile south of Bailey Road (which is the main street of Festus and Crystal City), Jefferson County, Missouri, and a 1949 Mercury Station Wagon driven by appellant, the defendant below, who counterclaimed.
