After a jury trial, Tyson Danrail Evans was convicted of one count each of aggravated *165 assault, aggravated battery, possession of a firearm during the commission of a felony, discharge of a firearm on the property of another, and possession of a firearm by a convicted felon. He appeals from his conviction and the denial of his motion for new trial, arguing that the trial court erred by failing to merge his aggravated battery and aggravated assault convictions for the purposes of sentencing, and that the trial court impermissibly expanded the jury charge on aggravated assault.
