MEMORANDUM OF DECISION AND ORDER

SPATT, District Judge.

This case arises out of an incident on July 18, 2007 in which the plaintiff Ronald A. Nimkoff was arrested for obstructing governmental administration by the defendant Nassau County Police Officers Eric Dollhausen and Domenick Orefice. As a result of his arrest and his subsequent detention, Nimkoff asserts federal and state causes of action for false arrest, violation of his constitutional rights, assault, and battery.
