1Opinion of the CourtRodman, J.

By an Act ratified 28th of February, 1873, (Acts of 1872-73, chap. 115, sec. 15,) the General Assembly .enacted that “ all persons who are liable for a poll tax, and shall wilfully fail to give themselves in, and all persons who •own property and wilfully fail to list it within the time allotted, before the list taker and the county commissioners, shall be deemed guilty of a misdemeanor, and on conviction therefor, •shall be fined not more than fifty dollars, or imprisoned not more than thirty days. The same provision is found in the Act of 1873-74, chap. 133, sec. 19.
