Defendant appeals from his convictions for robbery-in the first degree, ORS 164.415, robbery in the third degree, ORS 164.395, and felon in possession of a firearm, ORS 166.270, which arose from three separate incidents. Defendant asserts, in part, that the trial court should have entered a judgment of acquittal on the charge of robbery in the third degree, because the state failed to prove that he “use[d] or threaten[ed] the immediate use of physical force upon another person.” ORS 164.395(1).
