On the 11th day of September, 1897, The Montreal Gold Mining and Milling Company, by its written contract of that date, leased the Fluorine mining claim to W. J. Scott for the term of fifteen months, upon the conditions specified in the contract. On the 11th day of November, 1897, Scott, by assignment in writing, indorsed upon the contract, transferred to J. O. Hardwick all his right, title and interest in and to the lease. On the 29th day of November, 1897, J. O.
