Plaintiff-appellant and cross-appellee, the state of Ohio, appeals a decision of the Warren County Court of Common Pleas dismissing the indictment against defendant-appellee and cross-appellant, Michael J. Crawley, on double jeopardy grounds.

On October 16, 1992, appellee went left of center and collided head-on with another vehicle, severely injuring its occupants. Appellee was cited for operating a motor vehicle without reasonable control in violation of R.C. 4511.202. He entered a plea of no contest to this charge in the Warren County Court and was found guilty.
