THOMAS, District Judge.

The Malcom Brewing Company, organized about 12 years ago for brewing business, owns land on which there is a well-equipped brewery and malthouse, and stable buildings, in the borough of Brooklyn, mortgaged for the sum of $200,000, to-secure 6 per cent, bonds due January 1, 1906. For the last several years the business of the corporation has declined largely, and the stockholders have made loans to the company to the amount of $150,000, for which were given notes, upon which" no interest has been paid for two years.
