In order to answer the first question it is necessary to bear in mind the meaning of the term “cause of action.” The Civil Code (1910), § 3652, declares: “For every violation of a contract express or implied, and for every injury done by another to person or property, the lav/ gives a right to recover, and a remedy to enforce it.” In Ellison v.
