This is an appeal from a conviction and sentence in the Municipal Court of Defiance for a speeding violation. The defendant, the appellant herein, was charged with operating his car at the rate of 75 miles per hour on a road on which the prima facie speed limit, under R. C. 4511.-21, was 60 miles per hour. The assignments of error are that:

1. The trial court erred in denying a motion of the defendant for dismissal of plaintiff’s complaint for insufficient evidence; and

2. The judgment of the court is not sustained by the evidence.
