“This action was commenced on the 15th day of Octo ber, 1923, by the service of the summons and complaint, wherein plaintiffs demanded judgment against the defendant for the sum of $5,466.41, the amount due the plaintiffs-by reason of the alleged negligence of the defendant in cashing certain checks payable to the plaintiff, J. Clifton. Rivers.
