BUFFINGTON, Circuit Judge.
On October 2D 1920, H. Clay Mc-Elwain, a Pennsylvania farmer, confessed judgment in a state court for $4,000 in favor of the First National Bank of Delta, Pa.
The Pennsylvania Insolvency Act of June 4, 1901 (P. D. 404; Pa. St. 1920, § 779), provides:
