MEMORANDUM OPINION AND ORDER
GETZENDANNER, District Judge:
This action for rescission of a contract and payment of pension funds was removed here from state court approximately one year ago. The matter is currently before the court on the motion of plaintiff Clayton J. Graham to dismiss the amended counterclaim filed by defendant Jay E. Slaughter. On June 17, 1985, the court entered judgment for plaintiff on his ERI-SA claim to recover vested pension benefits.
