MEMORANDUM

TRAUGER, District Judge.

Pending before the court is the plaintiffs Motion to Remand for lack of Subject Matter Jurisdiction (Docket No. 11) and the defendant’s Response (Docket No. 17). For the reasons stated herein, the plaintiffs motion will be GRANTED.

I. Facts and Procedural History

On December 13, 1998, the plaintiff was injured in an automobile accident, when the car in which he was a passenger was struck by a vehicle driven by Zella Lynn. (Docket No. 1, attach. Ex.
