The complaint in this action alleges that defendant is indebted to the plaintiff in the sum of forty dollars for work, labor and professional services performed by plaintiff at defendant’s special instance and request, for which he promised and agreed to pay, but has failed therein, although demand for payment has been made. A copy of the complaint, duly verified, was served with the summons.
