This is an action of assumpsit to recover for Use and Occupation by the defendant of a stable and Warehouse in the city of Altoona, for the period of sixteen months ending December 22, 1898. The plaintiffs afterwards brought another action against the defendant to recover for the occupancy of the same premises during a subsequent period. These two cases Were tried together in the court below and the records present the same questions.
