This appeal is from a judgment of the county court of Shelby county. On December 21, 1931, the appellee filed a motion to dismiss the appeal, because, among other things, the appeal bond filed by appellant was not in accordance with law, in that the clerk of the trial court had not fixed and properly certified the probable amount of the costs, as required by article 2265, R. S. 1925. On December 31, 3931, the motion came on for consideration. Inspection of the bond showed it to be defee-tive in the particular complained.
