DOWD, Presiding Judge.

Eric Shelton, herein defendant, was charged with three counts of tampering with a motor vehicle. He was convicted under Count I of the information and sentenced to one year imprisonment in County Jail. The defendant was acquitted on Counts II and III.

Defendant raises two points on appeal, the first being that the trial court erred in denying his motion for acquittal at the close of all the evidence on the ground that the *659evidence presented by the State was insufficient to submit the case to the jury.
