Fowler was tried, at the last term of the court of oyer and terminer in the city of FiewYork, on an indictment charging him, together with John Gil. bert, with obtaining money by false pretences from Christian Heine.
*494The substance of the charge is, that Fowler and Gilbert, on the 14th of October, 1859, at the said city, knowingly and falsely pretended and represented to the said Heine that a certain instrument in writing, of which a copy is hereinafter set forth, was a genuine ticket, entitling him to a passage to Bremen, that there was a steamship called the…
