This action is brought to recover from the defendant an indemnity in respect of the damages, which the plaintiff and others, his assignors, and their copartners with him, under the firm name of the Minnesota Stage Company, have been adjudged to pay, and which plaintiff has since paid, t'o the administratrix of Matthew McLean, who was drowned while crossing a ferry owned by defendant and others, in one of the stage company’s coaches in which he had taken passage.
