ALTIMARI, Circuit Judge:

The United States appeals from the sentence imposed on resentencing of defendant-appellee Nandkishore Terry Arjoon by the United States District Court for the Southern District of New York (Robert W. Sweet, Judge), following Arjoon’s conviction for embezzlement after entering a plea of guilty. In resentencing Arjoon, the district judge departed downward from the specified range in the United States Sentencing Guidelines (“U.S.S.G.” or “Guidelines”).
