PRATT, J.,

After a jury trial, which was completed on March 28, 1995, all parties timely filed motions for post-trial relief in accordance with Pa.R.C.P. 227.1. Due to a delay in the court stenographer transcribing the notes of testimony, oral argument of the motions was not conducted until December 13,1995 at which time defendant Taylor Township, upon its own motion, was granted leave to withdraw its motion for post-trial relief. The matters remaining before this court, therefore, are defendant CSX Transportation Inc.’s motion for post-trial relief in the nature of a motion for judgment…
