I. INTRODUCTION

On July 19, 1999, judgment entered in favor of the defendants, Modern Continen tal Construction Company, Inc. (“Modern Continental”) and Charles Madden (“Madden”) on plaintiff Michael Hurley’s (“Hurley”) claim under the American With Disabilities Act (“ADA”), 42 U.S.C. §§ 12101 et seq. (#235) In addition, the state law disability claim alleged in the complaint was dismissed without prejudice. (# 235) 2
