Appellant, C. M. Stringer, instituted this suit in the district court of Hunt county against appellee, J. L. Urquhart, and from an adverse judgment has prosecuted his appeal to this court.
Appellant alleged in his petition that he was the owner of 50 acres of land in Hunt county of the value of $5,000, incumbered for $1,500; that he made a contract with appellee to sell and convey to him this land for a consideration of $5,000, the consideration consisting of the assumption of the $1,500 Ren against the property, the payment of $500 cash, the delivery to him of a secondhand Oldsmobile Eight…
