This matter came before the Court on Defendant Penn Lyon Homes Corporation’s Plea in Bar. After oral arguments on September 14, 2007, the Court took the matter under advisement.

Facts

In August 2004, Linda and Richard Cash requested information from Defendant Penn Lyon Homes Corporation (“Penn Lyon”) regarding Penn Lyon’s modular homes. In response, Penn Lyon provided the Cashes with literature containing numerous representations as to the quality of Penn Lyon’s modular homes and as to the procedure for purchasing a Penn Lyon modular home.
