In its brief the appellant says that this is an action to foreclose an equitable lien on standing timber. A somewhat detailed statement of the facts, either admitted or found by us to be shown by ¿ preponderance of the evidence, will be necessary.

In February, 1909, Emil - Morsbach and wife and. Rudolph Morsbach and wife were the owners of certain lands in Thurston county, in this state, upon which was some valuable timber.
