The contract sued upon was made, if at all, in January, 1923. The defendant was a going corporation, which had been in business in Cedar Rapids for several years. The contract alleged to have been made- with plaintiff was so made between him and one. Bennett, on behalf of the corporation. Bennett was used as a witness by the plaintiff. -. Both Bennett and plaintiff- testified to the terms of the contract.
