Tbe defendant based bis refusal to pay tbe purchase price for tbe land described in tbe contract upon tbe ground tbat tbe land, consisting of four acres unimproved land, was included in a larger area which bad been by a former owner subdivided into lots and streets, according to a recorded map, and tbat this constituted a dedication of tbe land in controversy to public use or private easement as a parkway.
Plaintiffs insisted, however, tbat on tbe described land no streets or lots bad been laid off, and tbat on tbe map tbe four-acre tract was desig nated only as “Willowbrook”; and further that…
