This is an appeal from a grant of summary judgment.

In September 1979 plaintiff-appellant Wallis purchased a house and lot, receiving a warranty deed from the prior owner and executing a deed to secure debt and purchase money note to Home Federal Savings and Loan Association of Atlanta. The deeds were sent by the closing attorney to defendant-appellee Clerk of the Superior Court for recording.
