OPINION

NYE, Chief Justice.

This is an appeal from a judgment entered in favor of a subcontractor on the basis of the jury findings in a construction contract case. Defendants-appellants are J.M. Hollis Construction Company, Inc. (Hollis) and Trinity Universal Insurance Company (Trinity), the surety under the Payment Bond. Plaintiff-appellee Paul Durham Company (Durham) filed suit against appellants to recover money remaining due on his subcontract for dirt work on a Houston Independent School District project.
