MEMORANDUM OPINION AND ORDER

BUCKLO, District Judge.

Prior to his sudden death on February 17, 2004, Mark Franck (“Mr.Franck”) consulted with an insurance agent about purchasing a life insurance policy. He applied for a policy and the insurance company subsequently issued a policy and sent it to the agent, but Mr. Franck passed away a few hours before the agent called to arrange to deliver the policy to him. Mark Franck’s widow, Antonia Franck (“Mrs. Franck”), the primary beneficiary of that policy, believes that her husband had an enforceable policy with defendant Farmers New World Life…
