This case came on for trial before the court without a jury. The statutory provision for findings of fact and conclusions of law was not waived.

The plaintiff, Chester W. Chinn, was insured with the defendant, Butchers’ Mutual Casualty Company of New York, by an automobile' liability policy which provided for insurance against personal liability and property damage.
