— This case is now before us on the third appeal. The first trial resulted in a directed verdict for the defendant, and reversal upon plaintiff’s appeal. Borough v. Minneapolis & St. L. R. Co., 184 Iowa 210. The second trial resulted in a verdict for plaintiff, and a reversal upon defendant’s *131appeal. Borough v. Minneapolis & St. L. R. Co., 191 Iowa 1216.
