The appellant was convicted in the Court of Sessions of petit larceny, alleged to have been committed on the 5th day of November, 1886, and was sentenced to imprisonment in the penitentiary, at hard labor, for the term of one year. The prosecution was commenced on the 7th of June, 1887, and the true bill was found at September term, 1887, but the trial was had at February term, 1888, after the passage of the act of December 28, 1887 (19 Stat., 819), amending the law in respect to the punishment of the offence of petit larceny,…
