Appeal from judgment of the G-eneral Term of the Supreme Court, in the fourth judicial department, entered upon an order made the second Tuesday of June, 1883, which affirmed a judgment in favor of plaintiff entered upon a verdict. (Reported below, 30 Hun, 237.) The nature of the action and the material facts are stated in the opinion. The case is reported on a former appeal in 83 N. Y. 253. There must be some fraud or falsity in statements to constitute duress per minas.

The plaintiff seeks to recover in this action the amount of a promissory note given by him upon the settlement of a claim by defendant, that plaintiff’s son, who was in defendant’s employ, had, at different times, stolen Ms money.
The complaint alleged that the note was given in order to compound, and settle a supposed felony or misdemeanor, and that thé said note was extorted from the plaintiff and his wife by threats of public charges against the character of their son, and that the note was executed in fear of the same.
