This is an action for personal injuries said to have accrued to plaintiff by virtue of the defendant city’s negligence in failing to properly notify the plaintiff and other members of the public that a certain public street, then being paved, was withdrawn from public occupation. The plaintiff is a travelling agent, engaged in selling threshing machines, sawmills, etc. He had been prosecuting his calling in the country several miles from the city of Mexico and was returning therefrom to the hotel in that city at the time of his injury.
