The questions for decision in this cause arise upon bill, answers, exhibits, and agreed state of facts, and from which the following facts appear:
Cary & Richardson were merchants doing business at Courtland, in this state. Defendant E. Richardson loaned to Cary, in 1874, the sum of $2,000, for which Cary gave his two notes for $1,000 each, — one payable in one and the other in two years, with 10 per cent, interest from date; and also on the seventh of February, 1875, said E.
